§1. What the trademark check covers.
The trademark axis in an Etymolt verdict runs five checks in parallel against live registry data:
- USPTO Trademark Status & Document Retrieval (TSDR) — live registrations and pending applications across all Nice classes; phoneme-distance comparison against the full bulk file plus the TTAB proceeding corpus.
- EUIPO + UKIPO — European Union and United Kingdom registers; relevant for any brand with EU or UK customers.
- WIPO Madrid Protocol — international filings across all member states; the standard upstream check for brands planning international expansion.
- Famous-mark adjacency — short-circuit check against the curated famous-marks denylist (US 2(f) recognized + INTA famous-marks register + international famous-mark compilation), with phoneme-distance flagging at 0.18 cosine.
- Per-jurisdiction depth — JPO (Japan), KIPO (Korea), INPI (Brazil and France), IP India, CIPO (Canada), IP Australia, DPMA (Germany), and the remaining major OECD registers.
The output is one of four verdict tiers: PROCEED (clear all checks), DUE_DILIGENCE (workable with action items), ITERATE (workable on some axes, failing on others), or ABANDON (one or more fatal failures). Each verdict carries a per-check evidence trail.
§2. What the verdict means.
PROCEED · 85–100
Clear across all five axes. File, register, ship. The verdict permalink is the documentation the attorney will append to the clearance opinion.
DUE_DILIGENCE · 60–84
Workable, with action items. Likely requires a narrow spec-of- goods drafting, pre-clearance with a senior-mark holder, or registrar-level domain hedge. Attorney consult recommended.
ITERATE · 40–59
Workable on some axes, failing on others. The recommendation is to iterate to an adjacent candidate that preserves the passing axes and resolves the failing ones.
ABANDON · 0–39
One or more fatal failures. The candidate is not reachable without category-level pivot. The recommendation is to drop the candidate and pick a different shortlist.
